ROOSEVELT CHILDREN’S ACADEMY (RCA) APPENDIX 2: FREEDOM OF INFORMATION LAW (FOIL) POLICY

Freedom of Information Law (FOIL) Policy

This policy establishes procedures for Roosevelt Children’s Academy Charter School to comply with the New York State Freedom of Information Law (“FOIL”). Below are the school's rules and regulations regarding how the public may obtain records.

Requests for Public Access to Records

Requests for public information must be in writing and submitted by mail or email to the school’s Records Access Officer, designated by the School Chief Operations Officer. The Records Access Officer will respond within five business days in writing, indicating either (a) the request is granted or denied, or (b) an approximate date when the request will be granted or denied, which shall be reasonable under the circumstances.

Denial of Access to Records

If access to a record is denied, the requester may appeal the denial to the School Chief Operations Officer or their designee within 30 days. Upon receiving an appeal, the school will explain the reasons for further denial in writing or provide access to the records within ten business days. A copy of the appeal and the school's final decision will be sent to the New York State Committee on Open Government.

If an appeal is denied, the requester may bring a proceeding for review under Article 78 of the Civil Practice Law and Rules.

The school may deny access to records for reasons including, but not limited to:

  • Records exempted from disclosure by state or federal law.

  • Unwarranted invasion of personal privacy.

  • Impairment of contract awards or collective bargaining negotiations.

  • Records are trade secrets or would harm the competitive position of a commercial enterprise.

  • Records compiled for law enforcement purposes which, if disclosed, would interfere with law enforcement or judicial proceedings, identify a confidential source, or disclose confidential investigative techniques.

  • Endanger the life or safety of any person.

  • Records are inter-agency or intra-agency materials except for statistical or factual tabulations, instructions to staff that affect the public, or final policies or external audits.

  • Examination questions or answers requested before their final administration.

  • Disclosure would jeopardize the school's information technology security.

  • Records prepared under the authority of section eleven hundred eleven-a of the vehicle and traffic law.

Required Records

Roosevelt Children’s Academy Charter School shall maintain records including:

  • A record of the name, public office address, title, and salary of every officer or employee.

  • A reasonably detailed current list, by subject matter, of all records in the Education Corporation’s possession.

 

Fees

The school may charge a copying fee of $.25 per photocopy up to nine inches by fourteen inches or the actual cost of reproducing any other record.

Location and Hours for Public Inspection

Records are available for public inspection and copying at Roosevelt Children’s Academy Charter School, 105 Pleasant Avenue, Roosevelt, NY 11575, during regular business hours from 8:00 AM to 4:00 PM.

Public Notice

A notice containing the title or name and business address of the Records Access Officer and the appeals person or body, along with the location where records can be seen or copied, shall be posted in a conspicuous location wherever records are kept and/or published in a local newspaper of general circulation.

Severability

If any provision of this policy or its application to any person or circumstances is adjudged invalid by a court, such judgment shall not affect or impair the validity of other provisions or applications.

Designation of Records Access Officer

The School Chief Operations Officer designates the following person as the Records Access Officer:

The Records Access Officer ensures appropriate responses to public requests for access to records. This designation does not prevent officials who have previously been authorized to make records available from continuing to do so.

Fees

No fee is charged for inspecting records. Fees for copies are $.25 per page for photocopies not exceeding 9 by 14 inches. Fees for larger copies or other records are based on the actual cost of reproduction.

Public Notice

Public notice of the records access officers and appeals person or body, and where records can be seen or copies obtained, is posted in a conspicuous location and published in a local newspaper of general circulation.

Severability

If any part of these regulations is found to be invalid by a court, the rest remains valid.
